During a hearing on the classified documents case against Trump, Judge Aileen Cannon delivered a strong critique of the prosecution, questioning the double standard between it and the handling of similar materials by Biden.

Cannon challenged the DOJ to cite precedent for charging a former president under the Espionage Act and examined the timeline and processes around Trump’s security clearance post-presidency.

The judge’s rigorous scrutiny suggested the case against Trump is in peril.

While both cases involve technical legal issues, Trump’s is seen as less severe given his authority to declassify and storage of documents at an authorized location.

A guilty verdict would thus represent a politicized interference in elections, which some have noted would be a true threat to democracy.
