The Oregon Court of Appeals refused to override a lower court’s hold on certain gun control measures passed via ballot initiative in Oregon.
A county circuit judge had issued an injunction preventing implementation of a permit-to-purchase requirement and ban on “high capacity” magazines from Ballot Measure 114.
Gun rights groups had sued over the measure.
The state Attorney General appealed the lower court’s ruling, but the appeals court decided not to lift the hold, noting the measures had never taken effect since passing in 2022 and such stays typically maintain the status quo.
The appeals court also pointed out that predicting the ultimate outcome of the case was difficult as both sides were making reasonable arguments that could prevail.
